DACS Payback Scheme

We are writing to DACS’ Secondary Rights Mandating Groups regarding a significant risk to your member’s future income from the Payback scheme.

The Copyright Licensing Agency (CLA) issues licences to businesses allowing the photocopying of books and magazines. DACS collects a share of this CLA revenue and distributes it to visual artists, either directly or through their authorised representatives, each December via our Payback scheme.

Earlier this year a number of magazine publishers (members of the Professional Publishers Association, formerly known as the Periodical Publishers Association) decided to transfer their licensing mandates for the business sector from the CLA to NLA Media Access (Newspaper Licensing Agency), a licensing body which is owned by newspaper publishers. As a result of this switch the CLA have had to reduce the pricing of the licence fees that they charge to the business sector to reflect the reduction in the repertoire covered by their licences. This reduction in fees will start to apply from 2014.

As you know, it is our priority at DACS to protect artists’ rights and ensure that you receive fair remuneration for your artistic contribution. DACS does not currently receive a share of licensing revenue from NLA Media Access as they believe that their publishers have obtained rights which allow them to license secondary rights.

With your help we want to discover whether there is a basis to this claim and with this in mind we are asking you to distribute our survey to your members. This will provide us with the information we require as a basis on which we hope to be able to negotiate with NLA Media Access for a share of royalties for visual artists.

We will of course treat any information your members provide in the strictest confidence.
