Clinical photographers, especially those working in small departments, are at risk of finding themselves exposed to allegations which become difficult to defend if a third party is not present during the photographic session. Allegations might range from indecent assault to inappropriate comments, gestures or even facial expressions.
A good step towards medico-legal protection is to have a chaperone present during every patient photographic session. However, it is accepted that this might not be practicable, especially in smaller departments. It is therefore recommended that the clinical photographer should consider the use of a chaperone before photographing all patients but in any event it is advised that a chaperone should always be used in certain situations.
